Compulsory insurance of civil liability of an owner of vehicle is regulated by the Law of Ukraine “On Compulsory Insurance of Civil Liability of Owners of Surface Vehicles”.
Voluntary insurance of civil liability of owners of surface transport (including carrier liability) is regulated by the Insurance Rules of “Inter” IC
These types of insurance afford an opportunity to cover the following risks:Compensation for damage caused to the life and health of an injured person which is related to:
- treatment of the injured person;
- temporary disability of the injured person;
- continuous disability of the injured person;
- death of the injured person
Compensation for damage caused to the property which is related to:
- failure or physical destruction of a vehicle;
- failure or physical destruction of roads, road structures, traffic control devices;
- failure or physical destruction of an injured person’s property;
- works necessary for rescue of injured persons as a result of a traffic accident;
- failure of a vehicle used for the delivery of an injured person to the appropriate medical institution, or dirtying of a passenger compartment of this vehicle;
- evacuation of a vehicle from the place of a traffic accident.
Voluntary third party insurance (except for civil liability of owners of surface transport) affords an opportunity to cover the following risks:
- presentation to an Insured by third parties of lawful property claims presented according to the rules of legislation of the country provided for by an Insurance Agreement;
- voluntary confession by an Insured, nevertheless by previous consent of an Insurer, of his obligation to compensate for the third parties’ damages or expenses;
- coming into force of a court judgment according to which an Insured is obliged to compensate for the third parties’ damages or expenses.
